A Federal High Court in Abuja yesterday rejected a fresh ex-parte application by a member of the House of Representatives, Hon Abiodun Akinlade, seeking to restrain the Speaker of the House, Hon. Aminu Tambuwal from further acting as Speaker of the Lower House of the National Assembly.
The plaintiff, Hon Akinlade, had urged the court to stop Tambuwal from parading himself as the Speaker, pending the determination of his suit challenging the propriety of his continued stay in office.
But instead of granting the ex-parte application, Justice Ahmed Mohammed directed Akinlade to put Tambuwal and other defendants p on notice.
According to the judge, it would be most unfair to grant a restraining order sought through an ex-parte application against Tambuwal who had engaged lawyers to defend him in the suit.
Akinlade is a member of the Peoples Democratic Party(PDP) representing Yewa South/Ipokia Federal Constituency of Ogun State in the House of Representatives.
